Knoxville pedestrian killed in car accident

An accident on the Sunday after Thanksgiving left a pedestrian dead after he was struck by a car. The car accident took place in East Knoxville on Magnolia Avenue near Kyle Street. Police were investigating the incident, and no charges have been filed yet.

On that day the 66-year-old pedestrian was killed while crossing Magnolia Avenue when a 48-year-old driver’s car struck him. Although Rural Metro and Knoxville Fire Department personnel quickly responded, the victim was already dead when they arrived on the scene. The driver was taken to an area medical center for a blood test, although police said it was merely routine procedure, adding that there was no evidence of drug or alcohol use by the driver.

Here, both the driver and a witness left statements saying that the pedestrian had stepped out in front of the vehicle. Nonetheless, it may be that the driver was not paying a sufficient amount of attention to the road at the time of the accident. The Traffic Services Unit Critical Response Team continues to investigate, and the family of the victim may consider retaining legal assistance that may help them with performing their own investigation.

The family could also consider the possibility of a wrongful death suit. When a person dies through no fault of their own and as a result of someone else negligent or willful conduct, a wrongful death suit is often appropriate. Through such a suit, the family may be able to collect monetary compensation for their funeral expenses and for their pain and suffering.
