Pregnant woman suffers critical injuries in truck accident

A Tennessee accident on a recent Tuesday evening during the last week of January did not only leave one woman critically injured, it also killed her unborn child.  The father of the baby has been left devastated by the truck accident. Not only does he have to deal with the loss of his unborn child, but his mother was also fatally injured in the crash.

According to authorities, the accident was caused by an alleged DUI truck driver who skipped a red light. The truck struck a sedan driven by the father-to-be. The impact was so severe that the driver’s mother was flung from the vehicle. She was critically injured and passed away in the hospital. The driver of the car escaped injury.

Both the truck driver and his passenger have been arrested and charged with leaving a fatal accident scene. The truck driver is also facing charges for vehicular homicide, driving under the influence and reckless driving. To make matters worse, he was driving without a license as well as insurance. More charges may follow, should the autopsy of the unborn baby prove that the accident was the direct cause of death.

Regardless of the outcome of the criminal case, the family may choose to file a wrongful death claim on behalf of the estate of the deceased mother, while the critically injured female may choose to file a personal injury claim against the truck driver. In Tennessee, a victim of a truck accident and/or their families may elect to file a civil claim for damages suffered. Should the evidence prove that negligence is the root cause of an accident, a court may award financial damages to the victims.
