Tennessee personal injury laws protect victims after accidents
McCaney Mill Road near Lexington was the site of a car accident which ended in injuries to one driver, and death to another two days after the incident. According to Tennessee Highway Patrol officials, the personal injury accident occurred when the 30-year-old driver of a car lost control of his vehicle. It is believed that he over-corrected after running off the road, causing his vehicle to end up in the oncoming traffic lanes.
After entering the oncoming traffic lane, the car struck a pickup truck. The driver of the pickup truck, a 32-year-old man, sustained injuries though the extent and nature of these injuries was not disclosed. The driver of the car that lost control died two days following the accident at Vanderbilt Medical Center in Nashville.
Troopers state that neither driver was wearing a seatbelt at the time of the collision. The condition of the driver of the pickup truck has not been updated since the initial reports following the accident. Reports do not indicate whether officials believe outside factors, such as alcohol or speeding, to be involved in the collision.
When the person responsible for causing a personal injury accident in Tennessee succumbs to their own injuries, he or she may still be held liable for the injuries caused to other parties. This may be accomplished through the injured party’s utilization of Tennessee’s personal injury laws. Filing a civil claim against the estate of the deceased driver deemed responsible can, if successfully litigated, provide monetary compensation for the victim as he or she works through the process of recovering from their injuries.
